An order to surrender property issued before the expiry of the time specified in the prior notice of the exercise of a hypothecary right may be annulled by the court on the application of the possessor or holder of the property if the allegations in the original application that led to the issue of the order are insufficient or false.
The application for the annulment of the order must be notified to all the parties to the proceeding within five days after notification of the order.
If the order is annulled, the creditor is required to return the property or pay back the alienation price, as applicable.
